Terms of Service

These Terms govern your use of the Tyze iPhone app, Tyze Premium, social accountability features, this website, and related services.

Tyze is a planning and reflection tool. It is not medical, financial, legal, or professional advice. Group stakes are symbolic only. Tyze does not offer wagering, cash prizes, money transfers, or debt collection.

1. Agreement and eligibility

These Terms of Service form a legal agreement between you and Tyze, operated by its independent developer, Jongbin Lee. By downloading, accessing, purchasing, or using Tyze, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Tyze.

You must be at least 13 years old to use Tyze. If you are not the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. You may not use Tyze if applicable law prohibits you from doing so.

2. The Tyze service

Tyze helps you set time, count, and session goals, log activity, estimate focused time, view personal trends, use optional reminders and Screen Time tools, connect with friends, and participate in symbolic group stakes.

Performance Scores, focus scores, streaks, reminders, projections, and other insights are estimates for personal reflection. They may be incomplete, delayed, or affected by device permissions, offline use, system limits, or information you enter. Tyze does not guarantee any personal, educational, health, financial, or productivity outcome.

Features that use Location, Calendar, Notifications, Focus, Family Controls, Screen Time, Siri, Live Activities, or widgets depend on Apple technologies and permissions. Apple may limit, change, delay, or disable those capabilities. Tyze is not a safety, emergency, medical, or location-monitoring service.

3. Accounts

Tyze uses Sign in with Apple. You are responsible for maintaining the security of your Apple account, device, and Tyze account. You must provide accurate information and keep your profile reasonably current. Do not share access to your account or use another person's account.

Tell us promptly at support@tyze.app if you believe your account is compromised or being used without permission. You are responsible for activity under your account to the extent permitted by applicable law.

4. Tyze Premium and subscriptions

Tyze may offer a free tier and auto-renewable monthly or annual Tyze Premium subscriptions. Current features, billing periods, free trials or introductory offers, and local prices are displayed before you confirm a purchase. Features may vary by version, region, or platform.

  • Payment is charged to your Apple Account when you confirm the purchase.
  • A subscription renews automatically unless you cancel it through Apple at least 24 hours before the end of the current billing period, subject to Apple's applicable purchase terms.
  • Apple charges renewal to your Apple Account. You can manage or cancel subscriptions in your Apple Account subscription settings.
  • Cancellation normally takes effect at the end of the paid period, so Premium remains available until then.
  • Refund requests and billing disputes are handled by Apple under Apple's policies, except where applicable law requires otherwise.
  • You can use Restore Purchases in Tyze to restore an eligible purchase associated with your Apple Account.

We may change Premium features or prices prospectively. Apple will provide any notice or consent process required for a subscription price change. If Tyze discontinues a paid service, we will respect access through the period required by law and our agreements with Apple.

5. Friends and symbolic group stakes

Social features let you connect with people, share selected progress, and make accountability promises. You control whether a goal is shareable and whether to accept a friend or group invitation. Group members can see the information needed to understand the group, including profiles, attached goals, progress, outcomes, and the symbolic consequence.

Every stake in Tyze is symbolic and non-monetary. Tyze does not hold funds, set odds, decide legal obligations, transfer value, enforce a consequence, or collect a debt. A phrase such as buying coffee is a personal promise between the participants, not a financial product or legally adjudicated award. Participants are responsible for choosing lawful, safe, respectful consequences and deciding privately whether to carry them out.

You agree not to create, request, or enforce a consequence that:

  • involves gambling, wagering, cash pools, or prohibited transfers;
  • is unlawful, dangerous, coercive, exploitative, or discriminatory;
  • involves harassment, humiliation, sexual content, or self-harm;
  • targets a child or vulnerable person inappropriately; or
  • violates another person's rights or a platform rule.

You may leave a group or remove a friend using available controls. Tyze may remove or restrict social content or accounts that create a safety, legal, or abuse risk.

6. Acceptable use

You may not:

  • use Tyze for an unlawful, fraudulent, harmful, or abusive purpose;
  • impersonate someone or misrepresent an affiliation;
  • harass, threaten, stalk, shame, or exploit another person;
  • upload content that violates privacy, publicity, intellectual property, or other rights;
  • probe, disrupt, overload, bypass, or compromise Tyze or its security;
  • use automated means to scrape, harvest, or access the service except through tools we expressly provide;
  • reverse engineer or attempt to extract source code except where applicable law does not allow that restriction;
  • resell, sublicense, or commercially exploit Tyze without permission; or
  • help another person do any of the above.

7. Your content and feedback

You retain ownership of content you enter or upload, such as your display name, photo, goal labels, and group descriptions. You grant Tyze a limited, non-exclusive, worldwide license to host, copy, process, transmit, and display that content only as needed to operate, secure, and improve the service and provide the features you request. This license ends when the content is deleted from active systems, subject to backup, legal, and security retention described in the Privacy Policy.

You represent that you have the rights needed to submit your content. You are responsible for what you share and should not include confidential or sensitive information in fields visible to friends or group members.

If you send suggestions or feedback, you allow us to use them without restriction or compensation, provided we do not publicly identify you without permission.

8. License and ownership

Subject to these Terms, Tyze grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Tyze app on Apple-branded products you own or control, as permitted by the Apple Media Services Usage Rules. Family Sharing or volume purchasing may allow use by associated accounts where Apple permits it.

Tyze, including its software, design, brand, text, graphics, and technology, is owned by Tyze or its licensors and is protected by intellectual property laws. Except for the limited license above, no right, title, or interest is transferred to you.

9. Terms required for Apple platforms

These Terms are between you and Tyze, not Apple. Tyze, not Apple, is responsible for the app and its content, maintenance, support, product claims, privacy obligations, and intellectual property claims.

  • Apple has no obligation to provide maintenance or support for Tyze.
  • If Tyze fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by Apple's rules. To the maximum extent permitted by law, Apple has no other warranty obligation for Tyze.
  • You represent that you are not located in a country subject to a United States government embargo and are not listed on a prohibited or restricted parties list maintained by the United States government.
  • You must comply with applicable third-party terms when using Tyze.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific terms against you.

The license terms in this section are intended to meet Apple's minimum requirements. Apple's Standard Licensed Application End User License Agreement also applies to the extent incorporated by the App Store and not replaced by valid custom terms.

10. Suspension, termination, and account deletion

You may stop using Tyze at any time. You can delete your account in the app under Profile. Deleting your account is irreversible and does not automatically cancel an Apple subscription. Manage any active subscription separately through Apple.

We may suspend or terminate access if you materially or repeatedly violate these Terms, create a safety or security risk, misuse social features, fail to pay an amount due through the App Store, or if required by law. Where reasonable, we will provide notice and an opportunity to address the issue. We may also discontinue Tyze or a feature, subject to applicable law and obligations to paid subscribers.

Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, dispute terms, and licenses needed for lawful retention.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, Tyze is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes a warranty or consumer right that applicable law does not allow us to exclude.

To the maximum extent permitted by law, Tyze and its developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, goodwill, or data, arising from Tyze. Our total liability for all claims relating to Tyze will not exceed the greater of the amount you paid for Tyze during the 12 months before the event giving rise to the claim or CAD $50.

These limits do not apply where prohibited by law, including where applicable to fraud, wilful misconduct, gross negligence, personal injury, or non-waivable consumer rights.

12. General terms

Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts located in Ontario will have non-exclusive jurisdiction. This choice does not deprive you of mandatory rights or protections available under the law where you live.

Changes

We may update these Terms as Tyze changes or legal requirements evolve. For material changes, we will provide reasonable notice before the new terms take effect. Continuing to use Tyze after the effective date means you accept the updated Terms, to the extent permitted by law.

Other provisions

If part of these Terms is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Tyze service. These Terms, the Privacy Policy, and applicable Apple purchase and license terms form the entire agreement about Tyze.
